  Like the idea also considering many spouses have gambling or shopping problems that run the entire family into debt. Like health insurance, there could be preventative 'check ups'/ counseling, that would either lower the rates, or make the couple elligilble. I do like the idea of the "stay together" payback. Divorce rates are so high that betting that a couple will stay together is a long shot.

  just a random thought - you could also offer "stay together" insurance
  if the couple stays together for x number of years, they get the money back

  The idea is kind of done now. It is called a prenuptial document. it is legal in most states and usually accept be judges. I see 2 problems:1)finding a buyer and an insurance company to sell the product at a reasonable cost. The Insurance business is simply a bet. The insurance company is betting you will stay blisfully married. You are giving them money in premiums to cover your losses just in case marriage doesn't work.
  Do both parties pay the premium? If not does one advise the mate that such a policy exists? And what will the discovery of the policy do to the marriage trust level.
  If you are to form the insuarnce company your self how much do you need in capital when 50% or more of all marriages fail. Would you be liable for causing the failures if you accidentally disclosed to the mate the existence of such a policy. Lots to do on this one... Good luck.
  AND remember most people get married thinking they will be together forever, why in the world would they want or need such a policy at such a high premium cost. Maybe a local Hollywood niche market.

  As the product of a broken home, I find this idea really intriguing... It si ironic too, because jsut the other day I was talking about "relationship" insurance with a friend of mine: an insurance program where you could recollect all the money you spent on dates, etc.
  
  Obviously the insurance industry is a large and complicated piece of machinery, so getting this off the ground will require a lot of heavy lifting and nimble footwork. My other thought about this is tort law: its kind of like the carnival game where you 'bonk the weasel' as soon as you think youve found a solution to one part of the problem, that very solution causes another area to become a problem. In this case, it may just encourage the judge to award more than %50 of marital assets to the spouse... or maybe it could be used against you in some sort of way. I am really not an expert in this subject, but I just thought I would bring this up for consideration.
  
  Very interesting idea though! I strongly encourage you to develop it, and think about it some more.
